By accessing or using roundbol.com (the "Site") or purchasing products from Roundbol LLC ("Roundbol," "we," "our," or "us"), you agree to these Terms of Service. If you do not agree, do not use this Site or our products.

Use of the Site

You agree to use this Site for lawful purposes only and not to:

  • Misuse, interfere with, or attempt to gain unauthorized access to the Site or its content
  • Use automated tools (bots, scrapers) to access or collect data from the Site
  • Submit false or misleading information

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

Product Use & Assumption of Risk

Roundbol is a recreational outdoor game that involves physical activity and the use of equipment, including pointed stakes.

By purchasing and using Roundbol products, you acknowledge and agree that:

  • Participation in outdoor recreational games carries inherent risks, including but not limited to impact injuries, tripping, falling, and contact with game equipment
  • Stakes are pointed objects intended only for use in sand or soft dirt and must be fully inserted below ground level before play
  • Stakes must never be used on hard surfaces including concrete, asphalt, artificial turf, or packed/frozen ground
  • Stakes must never be thrown, used as projectiles, or used in any manner other than as ground anchors
  • Adult supervision is required for all players under 18
  • Players are responsible for inspecting the playing area for hazards before setup
  • All players assume full responsibility for safe setup, proper use, and supervision during gameplay

You voluntarily assume all risks associated with the purchase and use of Roundbol products, including all risks of bodily injury, property damage, or other harm arising from gameplay, setup, takedown, or transport of game equipment. This assumption of risk applies to you and any person you allow to use the product.

Roundbol LLC is not responsible for injuries, accidents, property damage, or other losses resulting from:

  • Improper setup or misuse of any game component
  • Failure to follow included safety instructions
  • Use on inappropriate surfaces
  • Unsupervised use by minors
  • Modification or alteration of any game component

Product Warranty

Roundbol products are warranted against manufacturing defects for 90 days from the date of delivery. This warranty covers defects in materials and workmanship under normal use.

This warranty does not cover:

  • Normal wear and tear
  • Damage from misuse, abuse, or improper storage
  • Damage from use on inappropriate surfaces
  • Cosmetic damage that does not affect function
  • Products modified or altered from their original condition

To make a warranty claim, contact support@roundbol.com with your order number and photos of the defect. If your claim is approved, we will replace the defective component or product at no charge.

Except for the limited warranty above, products are provided "as is" without any additional warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by applicable law.

Orders & Payment

  • All prices are listed in USD
  • Payment is due at checkout
  • We reserve the right to cancel or refuse any order, including orders flagged for potential fraud
  • Prices and product availability are subject to change without notice
  • We are not responsible for typographical errors in pricing — if an error is discovered, we will notify you and cancel the order unless you agree to the correct price

Intellectual Property

All content on this Site — including text, images, logos, product designs, photography, and graphics — is the property of Roundbol LLC and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, modify, or use any content without written permission.

Limitation of Liability

To the maximum extent permitted by applicable law, Roundbol LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, or goodwill — arising from:

  • Your use of or inability to use the Site or our products
  • Any injuries or damages resulting from product use
  • Any unauthorized access to your personal information
  • Any errors, interruptions, or defects in the Site

Our total liability for any claim arising from your use of the Site or our products shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence, fraud, or any liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless Roundbol LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our products
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Any claim by a third party related to your use of our products

Dispute Resolution

Informal resolution first. Before filing any formal legal action, you agree to contact us at support@roundbol.com and attempt to resolve the dispute informally for at least 30 days.

Governing law. These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Jurisdiction. Any legal action arising from these Terms or your use of the Site or our products shall be brought exclusively in the state or federal courts located in Colorado. You consent to the personal jurisdiction of these courts.

Modifications

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you (such as a banner on the Site).

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Roundbol LLC regarding your use of the Site and purchase of our products.
